Ninth Circuit stays order forcing State Department to reopen 2027 diversity visa lottery
The U.S. Court of Appeals for the Ninth Circuit on Thursday, Oct. 29, stayed a district court order that would have forced the State Department to open registration for the FY2027 Diversity Visa lottery by Nov. 1.
What happened
The panel said plaintiff Red Eagle Law, an immigration firm, likely falls outside the statute's zone of interests, though it added that it does not endorse the department's failure to open registration.
The program normally offers up to 55,000 green cards a year, and the appeal now proceeds on a regular briefing schedule.
